Environmental regulations are a significant aspect of international trade and play an instrumental role in business decisions. A sound knowledge of environmental legislations and compliance schemes is the key to both successful market entry and sustained success in export markets.
EPR stands for Extended Producer Responsibility which is based on the “polluter pays” principle - a notion which entails the assumption of responsibility for waste management by the economic actors instead of the local authorities. In practice, the responsibility is therefore transferred from municipalities to producers. The aim of EPR in the long run is to encourage producers to take into account environmental considerations in the packaging and design of their products.
Founded in 1991, the Environmental Reporting and Compliance Department of the German-French Chamber of Commerce and Industry has since gained extensive expertise, in particular in the national implementation of European legislation regarding packaging, electrical and electronic equipment and batteries. The Department provides exporting companies with expert advice and comprehensive support, enabling them to concentrate on their core business.

Extended Producer Responsibility (EPR) is a system in which manufacturers or distributors take financial and organisational responsibility for the disposal or recycling of products they produce or sell. In addition to the declaration for packaging, obligations for electrical and electronic equipment (WEEE) as well as batteries are also widespread in Europe. These obligations generally apply mainly to online merchants, who must submit detailed declarations for their household packaging that is placed on the market, as well as for certain types of products such as WEEE or batteries.

Since the amendment of the German Packaging act (VerpackG) came into force in July 2021, companies and importers that place packaging “not subject to system participation” on the market, have new obligations. In particular, the registration obligation on the LUCID platform of the Central Packaging Register Foundation (also known as ZSVR) will be extended to all manufacturers within the meaning of the German Packaging law and to the final distributors of service packaging.

Within the framework of the French law on circular economy (loi AGEC), it is provided that an EPR registration number be allocated to the producer for each EPR to which his products are subjected to. This registration number must appear in a contractual document or on the internet website, under penalty of sanction. The implementation of the registration number will allow to better identify the producers who are not compliant with their obligations as part of the EPR. More >
